Rules and Regulations of the Prestige Club Loyalty Programme

in force since 15 May 2018

 

I. General provisions

  1. These Rules and Regulations set down the conditions for the participation in the Prestige Club Loyalty Programme – hereinafter referred to as the Prestige Club Programme – and its operating rules.
  2. The Prestige Club Programme is addressed to every natural person.
  3. The Prestige Club Programme is organised by the Polish Prestige Hotels Foundation with its seat in Warsaw, ul. Baśniowa 3/305, 02-349 Warszawa, Poland, telephone number: +48 22 408 99 29,                     e-mail: info@hotelepph.pl, hereinafter referred to as the PPH Foundation.

 

II. Criteria for joining the Programme

  1. Every natural person of legal age who has full legal capacity and has completed the Declaration of Participation in the Prestige Club Loyalty Programme during their stay as a Guest at one of the PPH hotels or registered online at www.hotelepph.pl. as well as signed  a statement consenting to have their personal data processed for the Programme-related correspondence and marketing purposes is eligible to take part in the Programme.
  2. Confirmation of the Guest's accession to the Prestige Club Program is the activation of the Participant's individual account after submitting the legibly filled out and signed Declaration of Participation or after signing up online at www.hotelepph.pl. The participant is also entitled to receive the Prestige Club card if they wish it when submitting the Declaration of Participation at the hotel reception or during online registration at www.hotelepph.pl.
  3. The Prestige Club account and card are registered and can only be used by the owner, called from the moment of joining the Prestige Club Program - a Prestige Club Program Participant
  4. The Programme Participant may use the Prestige Club Card to log into the booking system and make a booking at www.hotelepph.pl or the hotel home page at special prices offered only to the Programme Participants.
  5. The Prestige Club Card is valid for an unlimited period.
  6. The Prestige Club Card is not a credit or payment card.

 

III. Principles of the Programme operation

  1. Participants of the Prestige Club Programme receive dedicated, preferential rates for the accommodation services provided by the hotels affiliated with the Foundation (for basic offers including accommodation and accommodation with breakfast, or other specified by the Hotel), the same as catering services resulting from the invoice issued by the hotel reception.
  2. In order to be granted the special prices offered to the participants of the Prestige Club Programme, the Guest is obliged to do the following:
    1. when making a booking via hotelepph.pl or via the hotel’s own website, use their login and password to log into the Prestige Club zone,
    2. when making a booking per e-mail, telephone or directly at the hotel, notify the reception desk about their membership in the Prestige Club Programme upon placing the order (booking).
  3.  The Programme Participant awards points for each PPH hotel visit according to the following principle:
  1. For each full 100.00 PLN of the total amount spent on accommodation or catering services indicated on the invoice issued by the hotel reception, the Prestige Club Programme Participant receives 1 point if the booking was made by the Internet booking system available at www.hotelepph.pl and the hotel’s own website, after having logged into the zone of the Prestige Club, or via e-mail, telephone, fax or directly at the hotel.
  2. In the case of packages and special offers, the points are calculated according to rule set down in point 3a exclusively for accommodation and catering services.
  3. Should the Guest pay a part of their bill for services with the points, the hotel awards the points only for the remaining amount paid with other means of payment.
  1. The Hotel will not:
    1. Apply preferential prices dedicated to the Programme Participants if the Guest :
      • Took advantage of the catering services at prices differing from those listed in the menu
      • Used a different offer than the one defined in paragraph 1 above
      • Made the booking via a different booking system than www.hotelepph.pl or the hotel’s own website
      • Took advantage of corporate rates
      • Made the booking via a travel agent or travel office
      • Referred to participation in the Prestige Club Programme during their stay or at the time of the check-out from the Hotel.
    2. Award points if the Programme Participant:

- paid for the service with the points (excluding the situation as set down in point 3c)

- made the booking via a different booking system than www.hotelepph.pl or the hotel’s own website

- took advantage of corporate rates

- made the booking via a travel agent or travel office

  1. In any case other than described in point 4b above, after the Guest has pointed out to their participation in the Prestige Club Loyalty Programme, the hotel is obliged to award the points to the Programme Participants for the accommodation and catering services used by them. The points are awarded at the Guest’s check-out or as soon as possible after their departure, however, no longer than within 3 days.
  2. Collecting points starts after filling in the membership declaration and activating the individual Prestige Club account.
  3.  The Programme Participant may use their points awarded as described in part IV of the Rules and Regulations.
  4. The number of collected points can be checked after logging in on the website www.hotelepph.pl or in the mobile app Polish Prestige Hotels and entering the Prestige Club zone using your login (the card number) and password. The manner of obtaining the first password is described at the Prestige Club Card back and in the Prestige Club zone at: www.hotelepph.pl.

 

IV. Using the points

  1. Points collected by the Programme Participant may be used for settling accounts for services available at the hotels, according to the conversion factor where 1 point = 10 PLN. If the number of points is not sufficient to pay for the service, the remaining amount shall be paid in cash or by credit card.
  2. If the points have been used by the Programme Participant according to point 1 above, the number of points at the Participant's account is automatically decreased by the value of points used to pay for the service or its part paid with points.
  3. Points which have not been used within 3 years from the date of awarding them shall be deleted.
  4. The Programme Participant is not entitled to claim an equivalent from the Organiser, including                a financial one, for the points that have not been used.

 

V. Personal data

  1. Personal data of the Participants of the Prestige Club Programme will be processed in accordance with the provisions of the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (RODO/GDPR), and in particular with Article 5 of the above regulation for the needs of the Prestige Club Programme.
  2. The administrator of personal data of the Prestige Club Programme Participants is the PPH Foundation with its registered office in Warsaw, ul. Baśniowa 3/305, 02-349 Warszawa, Poland.
  3. The scope of personal data processed by the PPH Foundation includes: forename and surname, date of birth, e-mail address, address of residence, telephone number.
  4. Personal data of the Prestige Club Programme Participants will be processed for the purpose of implementing the Prestige Club Programme, i.e. for the purpose of providing hotel and catering services for Participants at dedicated, preferential rates in the group of Hotels affiliated to the Foundation.
  5. The legal basis for the processing of personal data by the PPH Foundation is the consent of the data subject - Article 6 paragraph 1 letter i of the RODO/GDPR.
  6. Personal data of Programme Participants will be processed for the duration of the Prestige Club Programme.
  7. The processing of personal data of Participants of the Prestige Club Programme for the purposes of proper implementation of this Programme may be transferred to the following categories of recipients:
  1. Hotels affiliated to the Foundation (the current list of hotels can be found at www.hotelepph.pl);
  2. Entities providing the PPH Foundation with technical and organisational solutions enabling the implementation of the Prestige Club Programme, with particular emphasis on the  booking system operator, ICT service providers, as well as courier and postal companies;
  3. Entities providing legal, accounting and advisory services ensuring the proper operation of the Prestige Club Programme.
  1. Providing personal data is voluntary, but necessary to join and participate in the Prestige Club Programme.
  2. The Participant has the right to:
    1. be informed about the processing of their personal data;
    2. access their personal data;
    3. rectify / complete their personal data;
    4. remove their personal data;
    5. restrict the processing of their personal data;
    6. transfer their personal data;
    7. object to the processing of their personal data;
    8. not to be subject to profiling.

If the Prestige Club Member wants to use any of the above mentioned right, they should submit a proper request, sent in the written form to the Organiser’s address: Fundacja PPH, ul. Baśniowa 3/305, 02-349 Warszawa, Poland or info@hotelepph.pl.

  1.  The Prestige Club Programme Member is also entitled to lodge a complaint with the authority supervising the protection of the personal data.

 

 

 

 

 

 

VI. Procedure of considering the complaints against the manner of the Programme implementation

  1. Complaints against the manner of the Programme implementation can be filed in writing and sent to: Fundacja PPH ul. Baśniowa 3/305, 02-349 Warszawa, Poland or info@hotelepph.pl, with the annotation Complaint (however, this annotation is not obligatory) within 30 days from the date of the event which the complaint refers to. Whether the complaint is time-barred or not is determined by the date of its delivery to the above mentioned address.  
  2. Only the Programme Participants are entitled to lodge a complaint.
  3. The complaint lodged in writing shall include the Participant’s full name and the detailed description of the reasons of the complaint.
  4. The Organiser will consider the complaints under the present Rules.
  5. The complaints shall be considered within 14 days of their receipt by the Organiser.
  6. The decision of the Organiser will be delivered to the Participant via the registered mail sent to the address indicated in the complaint or via mail (depending on the form of lodging the complaint) within 14 days of the complaint receipt by the Organiser. The Participant who does not accept the Organiser’s decision on the complaint has the right to seek redress before                              a competent court.

 

VII. Final provisions

  1. To the matters not regulated by the present Rules, the Civil Code provisions apply.
  2. The Polish Prestige Hotels Foundation reserves the right to modify the Prestige Club Loyalty Programme Rules. The Organiser will inform the Participants on each modification of the Rules at www.hotelepph.pl at least 7 days in advance. Only such modifications can be introduced that are beneficial for the Participants or are necessary due to technical and organisational reasons. The privileges which have been granted before the modifications are governed by the Rules as they had been before the modifications entered into force.
  3. Changes to the Rules and Regulations or termination of the Programme or the Participant’s resignation from the Programme cannot violate the rights obtained by the Participant by the date of change or the Programme termination or the Participant's resignation from the Programme.
  4. Notification on the planned termination of the Programme does not prevent the possibility to collect Points until the Programme termination.
  5. The Participants may resign from the participation in the Programme at any time by sending their request to exclude them from the Programme to the e-mail address: info@hotelepph.pl or to the PPH Foundation's Office address. The resignation enters into force on the date of delivery of the above mentioned request to the Organiser. The Participants retain their privileges acquired before the resignation date.
  6. All comments pertaining to the Prestige Club loyalty programme operation shall be addressed to the PPH Foundation's Office address or e-mail address: info@hotelepph.pl.

 

 

 

 

Rules and Regulations of the Prestige Club loyalty programme Polish Prestige Hotels & Resorts

II. Criteria for joining the Programme

  1. Every natural person of legal age who has full legal capacity and has completed the Declaration of Participation in the Prestige Club Loyalty Programme during their stay as a Guest at one of the PPH&R hotels or registered online at www.hotelePPH.pl. as well as signed a statement consenting to have their personal data processed for the Programme-related correspondence and marketing purposes is eligible to take part in the Programme.
  2. When a Guest has their individual account activated and their Prestige Club card issued directly at the hotel reception desk upon submitting the filled in legibly and signed Declaration of Participation or issued by the Polish Prestige Hotels Foundation Office after registering online on www.hotelePPH.pl, it is confirmed that the Guest has joined the Programme.
  3. The Prestige Club Card is the personal card and can be used only by the card owner who after joining the Programme is referred to as the Programme Participant.
  4. The Programme Participant may use the Prestige Club Card to log into the reservation system and make a reservation at www.hotelePPH.pl or the hotel home page at special prices offered only to the Programme Participants.
  5. The Prestige Club Card is valid for an unlimited period.
  6. The Prestige Club Card is not a credit or payment card.

III. Principles of the Programme operation

  1. The Programme Participants are offered special, lower prices at the hotels of PPH&R Group for:
    1. accommodation and catering services included in the bill issued by the hotel reception,
    2. accommodation and catering services included in the hotel services package,
  2. In order to be granted the special prices offered to the participants of the Prestige Programme Club, the Guest is obliged to do the following:
    1. when making a reservation via hotelePPH.pl or via the hotel’s own website, use their login and password to log into the Prestige Club zone,
    2. when making a reservation per e-mail, phone or directly at the hotel, notify the reception desk about their membership in the Prestige Club upon making the order (reservation).
  3. The Programme Participant awards points for each PPH&R hotel visit according to the following principle:
    1. For each full 100.00 PLN of the total amount spent on accommodation or catering services indicated on the invoice issued by the hotel reception, the Programme Participant receives 1 point if the reservation was made by the Internet reservation system available at www.hotelepph.pl and the hotel’s own website, after having logged into the zone of the Prestige Club, or via e-mail, telephone, fax or directly at the hotel.
    2. In the case of packages and special offers, the points are calculated according to rule set down in point 3a exclusively for accommodation and catering services.
    3. Should the Guest pay a part of their bill for services with the points, the hotel awards the points only for the remaining amount paid with other means of payment.
  4. The Hotel will not:
    1. Apply preferential prices dedicated to the Programme Participants if the Guest :
      1. Took advantage of the catering services at prices differing from those listed in the menu

      4. Notified the reception desk about their membership in the Programme upon the check-out from the hotel.
    2. Award points if the Programme Participant:
      1. paid for the service with the points (excluding the situation as set down in point 3c)
      2. made the reservation via a different booking system than www.hotelepph.pl or the hotel’s own website
      3. took advantage of corporate prices
      4. made the reservation via a travel agent or travel office
  5. In any case other than described in point 4b above, after the Guest has pointed out to their participation in the Prestige Club Loyalty Programme, the hotel is obliged to award the points to the Programme Participants for the accommodation and catering services used by them. The points are awarded at the Guest’s check-out or as soon as possible after their departure, however, no longer than within 3 days.
  6. Collecting the points starts right after having filled out the membership declaration and having received the valid Prestige Club card by the Programme Participant.
  7. The Programme Participant may use their points awarded as described in part IV of the Rules and Regulations.
  8. The number of collected points can be checked after logging in on the website www.hotelePPH.pl or in the mobile app Polish Prestige Hotels & Resorts and entering the Prestige Club zone using your login (the card number) and password. The manner of obtaining the first password is described at the Prestige Club Card back and in the Prestige Club zone at: www.hotelepph.pl.

  4. The Programme Participant is not entitled to claim an equivalent from the Organiser, including a financial one, for the points that have not been used.

V. Personal data

  1. The Programme Participant’s personal data will be processed in accordance with the Personal Data Protection Act (Journal of Laws of 1997, No. 133, item 883, as amended) for the purpose of the Prestige Club Programme and for the marketing purposes on the grounds of and within the scope of consent given by the Participant.
  2. The personal data of the “Prestige Club” Programme Participant are administered by the Polish Prestige Hotels Foundation with its registered office in Warsaw, Poland, at 27/9 Hoża Street.
  3. Providing the personal data is voluntary, however, it is necessary in order to participate in the Programme. The Participant has got the right to access their personal data, amend them and object to their processing for the marketing purposes. The Participant may request deleting their personal data, provided that they submit their request in writing and send it to the Organiser: Fundacja „Polish Prestige Hotels”, ul. Hoża 27/9, 00-521 Warszawa, Poland or to the e-mail address: info@hotelepph.pl. In such a case, the Programme Participant is excluded from the participation in the Programme.
  4. The processing of the personal data stored in the Prestige Club Program Participant database for the purpose of the Programme implementation will be entrusted to the Polish Prestige Hotels Foundation and the hotels of the Polish Prestige Hotels & Resorts Group (the updated list of the PPH&R hotels can be found on: www.hotelePPH.pl) according to Art. 31 of the Personal Data Protection Act.
